Effective date: November 6, 2026
Last updated: November 2026
These Terms of Service (“Terms”) are between you and Salt & Wind Travel LLC (“Salt & Wind,” “we,” “us”), 131 Manzanita Rd., Unit 4, Mammoth Lakes, CA 93546. They cover saltandwind.com, travel.saltandwind.com, the email sign-up and landing pages we host with our email provider, and our newsletters (together, the “Site”).
Please read section 13 carefully. If you agree to these Terms, it requires you to resolve disputes with us about the Site, our newsletters, our privacy or data practices on the Site, or these Terms by individual arbitration instead of in court, and it waives class actions. It applies only to disputes based on facts that occur on or after the date you agree, and you can opt out of all of it, including the class action waiver, within 30 days. Disputes about our travel planning services, and claims about calls and other communications with our planners, are not decided by arbitration under these Terms: a travel services agreement you have signed governs the disputes it covers, and otherwise they are decided in court (section 2).
1. Who these Terms apply to
1.1 Rules for everyone who uses the Site
Sections 4 through 10 set out who owns the Site’s content, what we allow, and what we do not. They describe the limits of the permission we give anyone to access and use the Site, whether or not you have agreed to these Terms. They do not ask you to give up any legal right. Sections 2, 8, and 11 are our notices to everyone about our travel registration and how to treat the Site’s information.
1.2 How you agree to these Terms
You agree to these Terms only by checking a box, which is never checked in advance, next to a statement that you agree to them, including the individual arbitration and class action waiver in section 13. Subscribing to our newsletter, submitting a trip inquiry, asking us to email you a post, buying from our shop, and browsing the Site do not by themselves mean you have agreed to these Terms.
Sections 3, 12, 13, 14, and 16, the last sentence of section 5, and section 11 as part of our contract apply between you and us only once you have agreed in this way, as do any other contract terms in these Terms. Section 15 explains how changes to each section take effect.
1.3 Age
You must be at least 18 years old to subscribe, submit an inquiry, or create an account on the Site.
1.4 Privacy Policy, Cookie Policy, and Consumer Health Data Privacy Policy
Our Privacy Policy, at https://saltandwind.com/privacy-policy/, our Cookie Policy, at https://saltandwind.com/cookie-policy/, and our Consumer Health Data Privacy Policy, at https://saltandwind.com/consumer-health-data-privacy-policy/, explain how we collect, use, and disclose personal information, and the choices and rights you have. They are notices, not contract terms.
2. Travel planning services
If you engage us to plan or book travel, that engagement is governed by the travel services agreement we provide at that time, together with the terms of the suppliers who provide your travel. Disputes about our travel planning services, and claims about calls and other communications with our planners, whether before or after you sign a travel services agreement, are not decided by arbitration under these Terms. If you have signed a travel services agreement, it governs the disputes and claims it covers, including where and how they are resolved, and a later change to these Terms does not change it; otherwise they are resolved in court under section 14. Claims about the Site itself, including cookies and the forms on the Site such as our trip inquiry form, stay under these Terms. These Terms govern your use of the Site.
Salt & Wind Travel LLC is registered with the State of California as a seller of travel, registration number CST 2130483-40, and is a participant in the California Travel Consumer Restitution Fund. Registration as a seller of travel does not constitute approval by the State of California.
2.1 Purchases in our shop
Our shop on travel.saltandwind.com sells our one-hour consultation call and digital travel planning tools. The seller is Salt & Wind Travel LLC, 131 Manzanita Rd., Unit 4, Mammoth Lakes, CA 93546. Prices are in US dollars, and payment is taken at checkout by the payment service that runs our shop. Our refund policy is linked at checkout, before you pay, and it applies to every purchase. For questions about an order or a refund, email shop@saltandwind.com.
3. Consent to data collection
On both of our sites, analytics, personalized advertising, and identity technologies that use your email address run only after you agree in our privacy pop-up, except for our email provider’s form statistics. Some other technologies run before you choose. On saltandwind.com, Raptive’s script loads on every page before any choice, in every state, including California, and whether or not your browser sends Global Privacy Control, and it sends Raptive the address of the page you are reading; what else runs before a choice depends on where you are. Section 9 of our Privacy Policy (“What runs before you choose”) and section 3 of our Cookie Policy explain which technologies run before a choice, which wait for it, and what each choice covers. On the trip inquiry form on travel.saltandwind.com, the form provider’s own analytics and marketing cookies also wait for a separate choice you make in the notice inside the form. Our Privacy Policy and Cookie Policy explain who receives the information, so that you can make your choice.
After you make a choice in our privacy pop-up, you can use the link at the bottom of every page. On travel.saltandwind.com, “Your Privacy Choices” opens our privacy settings, where you can change your choice. On saltandwind.com, the link described in section 9 of our Privacy Policy, whose wording changes with your choice, opts you out of personalized advertising and the sale or sharing of your personal information for it and, where section 9 says so, lets you change your choice. How Global Privacy Control works on our sites, including when a choice in our privacy pop-up overrides it, is explained in section 9 of our Privacy Policy.
When you submit a form, we use what you submit as described at that form and in our Privacy Policy. Submitting a form is not the separate consent our client forms ask for before collecting passport details, other government travel identifiers, or health, dietary, or accessibility details, or the consent we ask for before transcribing a call (Privacy Policy section 8). Agreeing to these Terms does not give consent to any of these technologies or uses, and does not replace or override the choices you make in our privacy pop-up, in a form’s notice, in our privacy settings, or through Global Privacy Control.
We do not ask you to agree to the privacy policies of other companies that the Site or our policies link to.
4. Our content
The Site’s design, layouts, text, recipes, guides, photos, and videos are created for Salt & Wind and are owned by us or our licensors. They are protected by copyright and other laws. Except as this section allows, we do not license anyone to copy, republish, or adapt them.
We love it when readers share our work. You may share links to our posts and quote short excerpts with credit and a link to the original post. Please do not republish our content, including photos, without our permission. Any photo used with permission must be credited to the photographer and linked to the original post.
5. No use of our content for artificial intelligence
We do not license or authorize anyone to use or download the content on the Site to develop, train, or operate artificial intelligence or other machine learning systems (“Artificial Intelligence Purposes”), except as we authorize in writing, including by electronic communication. Our permission to access the Site does not extend to accessing it, by automated means or otherwise, for Artificial Intelligence Purposes. We reserve all of our rights in the Site’s content against any such use. If you have agreed to these Terms, using the Site’s content for Artificial Intelligence Purposes without our authorization is also a breach of these Terms.
6. Ratings and comments
You can rate our recipes with stars. We do not ask for your name or email address to rate. Ratings are shown together with other readers’ ratings. We may remove any rating we believe is spam, automated, or abusive.
We no longer accept new comments. Comments posted before November 6, 2026 stay published under the terms that applied when they were posted, and we may remove any of them at any time.
7. Advertising, sponsorships, and affiliate links
saltandwind.com is supported by advertising; travel.saltandwind.com shows no ads. Some links on saltandwind.com are affiliate links, such as links to Amazon, and we may earn a commission if you make a purchase through them, at no extra cost to you. As an Amazon Associate, we earn from qualifying purchases. Some posts are sponsored or feature products we received as gifts.
8. Recipes and travel information
The recipes, travel guides, and other information on the Site are for general information and entertainment. Use them at your own discretion. You are responsible for judging whether a recipe or instruction is suitable and safe for you, including for allergies, dietary needs, and food safety. Travel information such as prices, opening hours, entry rules, and safety conditions changes often. Check with the provider or the relevant authority before you rely on it. Nothing on the Site is medical, legal, or financial advice.
9. Third-party sites and services
The Site links to other companies’ sites and services, such as hotels, restaurants, and retailers. We are not responsible for their content or products. Once you leave the Site or deal with them directly, their own terms and privacy policies apply, and your dealings with them are between you and them. Advertising and other third-party technologies that run on the Site, and what they receive, are described in our Privacy Policy and Cookie Policy.
10. Trademarks
Salt & Wind™ and our logos are trademarks. You may not use the names, logos, or trademarks of Salt & Wind or its licensors without our written permission.
11. Disclaimer of warranties
THIS SECTION IS NOTICE TO EVERYONE WHO USES THE SITE, AND ONCE YOU AGREE TO THESE TERMS UNDER SECTION 1.2 IT IS ALSO PART OF OUR CONTRACT. THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY RECIPE OR TRAVEL INFORMATION WILL PRODUCE A PARTICULAR RESULT.
12. Limitation of liability
This section is a contract term between you and us once you have agreed to these Terms as described in section 1.2. For everyone else, it is notice that we do not take responsibility for reliance on the free information on the Site.
TO THE FULLEST EXTENT PERMITTED BY LAW, SALT & WIND AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL COMBINED LIABILITY OF SALT & WIND AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR USE OF THE SITE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, WILLFUL INJURY, GROSS NEGLIGENCE, OR VIOLATION OF LAW WHERE CALIFORNIA CIVIL CODE SECTION 1668 OR A SIMILAR LAW APPLIES, AND THEY DO NOT LIMIT ANY RIGHT YOU HAVE THAT THE LAW DOES NOT ALLOW TO BE WAIVED. SOME STATES DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU. These limitations do not apply to travel services, or to claims about how we handle a client’s information in providing them, which are governed by the agreement described in section 2.
13. Dispute resolution: individual arbitration and class action waiver
This section applies only between you and us once you have agreed to these Terms as described in section 1.2.
13.1 Which disputes this covers, and which it does not
This section applies to any dispute or claim between you and Salt & Wind arising out of or relating to the Site, our newsletters, our privacy or data practices on the Site, or these Terms (“Dispute”), but only if the facts giving rise to the Dispute occurred on or after the date you agreed to these Terms.
This section does not apply to:
- (a) any Dispute based on facts that occurred before you agreed to these Terms;
- (b) any Dispute that you, or someone on your behalf, raised in a written claim, demand, notice, or lawsuit before you agreed to these Terms, or any Dispute asserted in a putative class or representative lawsuit filed in court before the effective date of these Terms in which you are a member of the proposed class as defined on that date;
- (c) claims that qualify for small claims court, as long as they stay there and proceed only on an individual basis;
- (d) claims by either of us seeking provisional or equitable relief for infringement or misuse of intellectual property;
- (e) a request for public injunctive relief, meaning relief whose primary purpose and effect is to prohibit unlawful acts that threaten future injury to the general public. You may bring that request in court at any time, including when a case begins. Any individual claims this section covers may still be decided in arbitration, but this section does not require the court to wait for the arbitration: whether to pause the court proceeding on the request is for the court to decide;
- (f) any dispute about our travel planning services, or any claim about calls and other communications with our planners or about information you give us after you sign a travel services agreement (such as in our client forms or your client profile), whether the facts occurred before or after you signed one; these are resolved as section 2 describes; or
- (g) a complaint you make to a government agency, a claim you file with the California Travel Consumer Restitution Fund, or any action by a government agency.
These Terms do not change the terms that applied to your use of the Site before you agreed to them.
13.2 Try to resolve it informally first
Before starting an arbitration, the person bringing the claim must send the other a written notice that includes their name, their contact information (including the email address they use with us, if known), a description of the claim and the facts, and the relief requested. Send notices to us by email at privacy@saltandwind.com or by mail to Salt & Wind Travel LLC, Attn: Legal, PO Box 3569, Mammoth Lakes, CA 93546. We will send notices to the email address we have for you. We will both try in good faith to resolve the Dispute for 45 days after the notice is received, and neither of us will start an arbitration before those 45 days end. Any limitations period is paused during those 45 days.
13.3 Individual arbitration
If we cannot resolve the Dispute informally, it will be resolved by binding individual arbitration administered by JAMS under its Consumer Arbitration Minimum Standards and its Streamlined Arbitration Rules and Procedures (or its Comprehensive Arbitration Rules and Procedures for claims over $250,000), available at www.jamsadr.com. If JAMS is not available, we will agree on another arbitration provider, or a court will appoint one. The Federal Arbitration Act governs this section.
The arbitration will take place by video, by written submissions, or in person in the county where you live, at your choice. A single arbitrator may award any individual relief, including damages and statutory remedies, that a court could award to you individually under the law, and must follow these Terms. Judgment on the award may be entered in any court with jurisdiction.
13.4 Fees
If you start an arbitration, your share of the filing fee will be no more than the amount JAMS’s consumer rules allow or the court filing fee you would pay, whichever is lower. We will pay all other JAMS administrative fees and the arbitrator’s fees, including under section 13.6, within the time the law requires, including, where California law applies, California Code of Civil Procedure sections 1281.97 and 1281.98 as construed under California law. Each of us pays our own attorneys’ fees and costs unless an applicable statute, or the arbitrator’s award under one, provides otherwise; nothing in these Terms waives a right to attorneys’ fees or costs that a consumer protection statute gives you. Neither of us may seek attorneys’ fees or costs from the other on the ground that a claim or defense was frivolous unless the arbitrator finds it frivolous under the standard in Federal Rule of Civil Procedure 11 and the law allows the award.
13.5 No class actions
You and Salt & Wind each agree to bring Disputes covered by this section only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. Except for the administrative coordination section 13.6 allows, the arbitrator may not consolidate claims of different people or preside over any form of class or representative proceeding. Nothing in this section 13.5 prevents you from seeking public injunctive relief in court as section 13.1(e) describes. If a court decides that this section 13.5 cannot be enforced for a particular claim or request for relief, that claim or request will be severed and decided in court and not in arbitration, and the rest of this section 13 will still apply to all other claims.
13.6 Mass arbitration
If 25 or more demands for arbitration that raise similar claims are filed against us by or with the help of the same law firm, organization, or coordinated group, you and we agree that the JAMS Mass Arbitration Procedures and Guidelines will apply to those demands. Under those procedures, the demands may be administered together, for example by sharing an administrator, scheduling, discovery, and rulings on threshold administrative questions (but not the questions section 13.7 reserves to a court), and each claimant’s claims will be decided on their own merits and in a separate award. Nothing in this section allows a class, collective, or representative proceeding, and if the procedures are read to allow one, section 13.5 controls.
13.7 Who decides
A court, not an arbitrator, decides whether an agreement to arbitrate was formed, including whether you agreed to these Terms; whether this section 13.7 can be enforced; whether section 13.1, including sections 13.1(e) and 13.1(f), excludes a Dispute or request for relief, including whether a travel services agreement governs it instead of these Terms; whether you opted out under section 13.8; and whether section 13.5 can be enforced. The arbitrator decides all other questions about the interpretation, application, and enforceability of this section.
13.8 Your right to opt out
You can opt out of this section 13 within 30 days after you first agree to these Terms by emailing privacy@saltandwind.com from the email address you use with us, with the subject “Arbitration Opt-Out” and your name, or by mail to Salt & Wind Travel LLC, Attn: Arbitration Opt-Out, PO Box 3569, Mammoth Lakes, CA 93546, with your name and the email address you use with us. A mailed opt-out counts from the date it is postmarked. Opting out removes all of this section 13, including the class action waiver in section 13.5 and the informal resolution and arbitration steps, and does not affect any other part of these Terms or your relationship with us. If you opt out, Disputes, as defined in section 13.1, will be resolved in court as described in section 14.
13.9 Changes to this section
If we make a material change to this section, we will email you the change, and it will apply to you only if you agree to it by a new affirmative action, such as checking a box. Silence or continued use of the Site is not agreement. If you do not agree, the version of this section you last agreed to continues to apply to you. A change never applies to a Dispute you or we gave notice of before the change.
13.10 Severability
If any part of this section is found unenforceable, that part will be severed and the rest of this section will remain in effect. Section 13.5 controls how a finding that the class action waiver cannot be enforced is handled. A request for public injunctive relief is never decided in arbitration (section 13.1(e)).
14. Governing law and courts
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules, and, for section 13, by the Federal Arbitration Act. Any dispute or claim of the kind section 13.1 describes, whenever the facts occurred and whether or not you opted out of section 13, that is not subject to arbitration will be brought in the state courts located in Mono County, California, or the United States District Court for the Eastern District of California, or, if you are a consumer, in the courts where you live, if you choose. The disputes and claims section 13.1(f) excludes are also brought in these courts, unless a travel services agreement you have signed governs them (section 2).
15. Changes to these Terms
We may update these Terms. When we do, we will change the “Last updated” date above and post the new version on the Site. If a change is material, we will also email it to people who have agreed to these Terms before it takes effect. Changes to sections 1.1, 1.3, 1.4, 2, 4 through 10 (except the last sentence of section 5), and 17, and to section 11 as a notice, apply to everyone from the date they are posted. Changes to sections 1.2, 3, 12, 14, and 16, to the last sentence of section 5, and to section 11 as part of our contract apply to you only once you agree to the changed Terms in the way section 1.2 describes. Changes to section 13 follow section 13.9. Except for section 13, where section 13.9 governs, a changed version applies only to Disputes based on facts that occur after it takes effect.
16. General
If any part of these Terms is found unenforceable, the rest remains in effect, except that section 13.10 governs section 13. Our failure to enforce a part of these Terms is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to a successor to our business. These Terms are the entire agreement between you and us about the Site. Our Privacy Policy, Cookie Policy, and Consumer Health Data Privacy Policy describe our practices and your choices; they are not contract terms. These Terms do not replace a travel services agreement, which controls for the travel services and the claims it covers (section 2).
